These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising, promotional materials and voucher terms displayed at redemption and on gift card. Entry instructions are deemed to form part of the Terms and Conditions and by participating, all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Entry instructions are deemed to form part of the terms and conditions and by participating in the Promotion all entrants will be deemed to have accepted and be bound by these terms and conditions.
- This promotion is open to residents of United Kingdom, aged 18 years or over except employees and their immediate families of the Promoter, their agents or anyone professionally connected with the promotion.
- Internet access, a valid email address, mobile phone number and smartphone required for entry. Purchase necessary, retain receipt.
- Opens for entries at 00:00 on 19th August 2024 and closes for entries at 23:59 on 31st December 2024. Entries received outside of this time will be void and will not be entered into the promotion.
- The promotion is limited to one eVoucher prize per person per day. A person is defined by unique mobile number.
- To enter the promotion, you must purchase a qualifying itsu rice’ noodles cups featuring the promotional flash (see clause 6 for list of promotional products), scan the QR code on pack or visit www.itsu-noodles-win.co.uk. Enter your details, including full name, email address, mobile number, the 8-digit code starting with L (on the bottom of the cup), select product purchased and the preferred chosen retailer for the eVoucher prize. Find out instantly online if you are a winner of an instant win prize. All valid entrants will also be entered into the prize draw for the chance to win a dream trip to Japan for two. - It is the responsibility of the winner and/or their guest to ensure they have read the latest passport advise, checked their availability to travel and that they have at least a minimum of 6 months validity on their passport from the date of return of travel. The hotel is selected and booked by the Promoter’s appointed supplier Cloud Nine Incentives. It is the responsibility of the winner and/or their guest to ensure that they have adequate travel insurance during travel. It is also the responsibility of the winner and their guest to ensure that they have complied with all necessary travel requirements, for example:
- The booking cannot be changed (e.g., dates, guest names, etc.) without incurring administration or cancellation fees for the travel/hotel/event operator. These fees would be the responsibility of the winner.
- All elements of the prize must be redeemed at the same time and taken within the 7 day trip.
- Once booked, the prize cannot be changed or supplemented if they cannot travel.
- The prize excludes anything not specifically set out in these terms and conditions, including any other meals and beverages (except for breakfast), excursions, attractions, treatments, car rental, travel insurance, personal expenses, and anything not expressly included in the prize description.
- Obtaining all necessary medical needs (including immunisations) and documentation, applicable to Japan.
- The holiday is valid for travel until January 2026 excluding travel over Christmas, Easter and all bank holidays. All travel must be completed by 31st January 2026.
- The winner and their guest are responsible for ensuring that they all have a valid passport with at least 6 months validity on their passport from the date of return, are eligible for any applicable visa waiver programme or are in possession of a valid visa.
- There are 4,300 online instant win prizes and the total promotional itsu packs out in the market is 1,700,000. Winners will be determined by a secure and automatic computer-generated algorithm that produces verifiably random results. Each entrant’s chance of winning is based on the promotional volume of 1,700,000 vs the number of prizes to be given away at the start of the promotion. The percentage chance of winning will not decrease across the promotional period. The number of prizes will be (statistically) dependent upon participation rates. Wins will be allocated independently by the system using an algorithm. Although all prizes are available to be won, there is no guarantee that they will all be claimed. The chances of winning is 1 in 395.
- Entrants will be notified immediately on screen online if they have won an Instant Win prize and informing them which eVoucher prize they have won. Winners will also receive an SMS within 24 hours confirming their win and which prize they have won, along with a link to claim their prize. Winners will have 14 days from their SMS win notification to click on the claim link to redeem their digital eVouchers.
- It is the responsibility of the entrant to ensure that they have accurately provided a valid mobile number to ensure they are in receipt of promotional communication.
- No alternatives or cash alternatives are available.
- The Promoter reserves the right to substitute the prize for an equivalent or greater value should the original prize offered become unavailable for reasons beyond the Promoter’s control.
- The Prize Draw winner will be electronically drawn at random by an independent third party from all valid entries correctly submitted in accordance with these terms and conditions within 7 days of the close date of the promotion. An appropriate number of reserves will be drawn at the same time as the winner. The winner will be notified by phone to the mobile number provided upon entry within 7 days of the prize draw. A maximum of 3 reserves will be contacted if the prize remains unclaimed after 7 days. The Promoters agent will attempt to contact the winning entrant no more than three times within 3 working days to award their prize. If the entrant does not answer the call after the third attempt but within 3 days of first contact then the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected at the same time as the Prize Winner.
Further Online Instant Win eVoucher Prize Terms
- The promotion is limited to one eVoucher prize per person per day.
- Claimants will receive their eVoucher by SMS within 24 hours once they have successfully submitted their entry and successful validation.
- Claimants must redeem eVoucher in their chosen retailer between 19/08/2024 -31/12/2024. Store redemptions are accepted in Asda, Morrisons (excluding Morrisons daily), Sainsbury’s, tesco and Waitrose Vouchers cannot be redeemed in petrol stations, online or Morrisons daily. Once redeemed and activated, the claimant will have 20 minutes to use their chosen eVoucher instore.
Further Trip to Japan Prize Terms
- The Promoter will accept no responsibility for hotels/ tours/ transport companies etc. being withdrawn or amended. In the event of this, the Promoter’s Prize Provider will endeavour to offer a suitable alternative. The Promoter is not responsible for changes in schedule or for any expenses incurred as a consequence of flight cancellation or delay.
- Bookings must be made through the Promoter’s Prize Provider Cloud-Nine Incentives.
- Any amendments made by the prize winner after the booking is confirmed may be subject to administration charges levied by the specific supplier.
- Please note that the Prize does not include, other than the amounts referred to in clause 7, any travel costs, insurance, meals and beverages, personal expenses, additional activities, or any other expenditure. The Promoter is not responsible for any expenses incurred. The winner is also responsible for the behaviour of themselves and their guest whilst enjoying the Prize. The Promoter reserves the right in its absolute discretion to exclude the winner and/or guest from utilising the Prize if the winner and/or their guest fail to comply with the directions of the Promoter or any companies associated with the Prize or the winner and/or guest act in a manner that is dangerous to themselves or to the public or is anti-social in any manner or which causes a disturbance or nuisance to others.
General
- All entries must be made by the entrant themselves. Bulk entries made from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries, entries made by macros or other automated means (including systems which can be programmed to enter) and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by, for example, the use of 'script', 'brute force', multiple SIM cards for Text entries, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means, fraudulently falsifying data, acting fraudulently or dishonestly to increase that entrant's entries into the Promotion in a way that is not consistent with the spirit of the Promotion, that entrant's entries will be disqualified and any prize award will be void. Prizes allocated to winners who are subsequently disqualified may not be reallocated.
- Winners may be requested to participate in reasonable publicity arising from the Promotion with no further compensation. The winner is under no obligation to participate.
- The prize draw winner surname and county are available by sending a correctly stamped self-addressed envelope to itsu Win a Trip to Japan 2024 (8169), PO Box 906, Chilton, Aylesbury HP22 9HR within three months of the Closing Date. By entering the Promotion, each entrant acknowledges that if they are a winner their surname and county may be disclosed to persons enquiring, where permitted by law. A winner may object to their information being made available in this way or may request that the amount of information made available be reduced, by contacting the Promoter. In these circumstances the winner acknowledges that the Promoter may nevertheless disclose such information in full upon request from such competent authorities (including without limitation the Advertising Standards Authority).
- In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, or reasonable belief to suspect collusion to subvert the terms of this promotion, and/or an error (human or computer) affects or could affect the proper operation of this promotion, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these terms and conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.
- The Promoter reserves the right to verify the eligibility of all entries to protect itself against fraudulent, invalid or repetitive entries including but not limited to asking for address and identity details (which they must provide within 14 days) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.
- The Promoter does not accept responsibility for entries lost, damaged or delayed or as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
- The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.
- The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances of the Promoter.
- If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
- The Promoter’s decisions regarding all promotional matters shall be final and no other correspondence will be entered in to.
- The Promoter will collect and process certain personal information from entrants which, by taking part in the promotion, the entrants’ consent to. The Promoter will only use the personal data for the purposes of carrying out the promotion and, if your consent is obtained, to send you emails containing news and offers from itsu [grocery] and for no other purpose, unless the Promoter obtains your consent. However, personal data supplied during the course of the promotion may be passed on to third party supplier only insofar as required for fulfilment/delivery/arrangement of the promotion. The personal details will at all times be kept confidential and in accordance with the UK General Data Protection Regulation (UK GDPR). - The Promoter does not assume any responsibility for any typographical or other error in the administration of the Promotion. Additionally, the Promoter is not liable for the reproduction of this offer or indirect access via third party websites of these Terms and Conditions and where such reproduction misstates or omits any of the information or terms and conditions connected with this Promotion.
- This Promotion is governed by English Law and the courts of England and Wales will have exclusive jurisdiction.
